How to Register a Yacht Under the Malta Flag

Registration Process Overview

Registering a yacht under the Malta flag follows a clear, two-stage process: provisional registration first, then permanent registration within 6 months. The entire pathway is managed through Transport Malta's Registrar-General of Shipping and Seamen.

With complete documentation, provisional registration can be issued in 2-3 working days. The 6-month provisional period gives you time to finalise any outstanding documents (such as the deletion certificate from the previous flag state) without delaying the vessel's ability to fly the Malta flag and operate.

Document Checklist

Before submitting the registration application, you'll need to gather the following documents. The exact requirements vary slightly depending on whether you're registering a new build, re-flagging from another register, or registering as a private vs commercial vessel.

Core Documents (All Registrations)

  • Bill of Sale: Original or notarised copy proving ownership of the vessel. Must clearly identify the buyer, seller, vessel name, and hull identification number.
  • Declaration of Ownership: A formal declaration made before the Registrar-General of Shipping and Seamen (or a consular officer abroad) confirming the owner's identity and entitlement to register.
  • Proof of Qualification to Own: For individuals, this is proof of EU/EEA/Swiss nationality. For companies, it's the certificate of incorporation (plus, for Maltese companies, a certificate of good standing).
  • Power of Attorney: Authorising the resident agent (such as Mercer Yachting) to act on the owner's behalf with Transport Malta.
  • International Tonnage Certificate: If applicable, issued by a recognised classification society confirming the vessel's gross and net tonnage.

Re-Flagging (Transfer from Another Register)

  • Deletion Certificate: Issued by the previous flag state confirming the vessel has been removed from their register. This can be submitted after provisional registration but must be provided before permanent registration.
  • Transcript of Registry: From the previous flag state, showing the vessel's registration history and any encumbrances.

New Builds

  • Builder's Certificate: Issued by the shipyard confirming the vessel's construction details, hull number, and delivery date.
  • Declaration of Conformity: CE marking documentation confirming the vessel meets EU construction standards (for vessels under 24m built after 1998).

Commercial Vessels (Additional)

  • Certificate of Compliance to Trade: Issued after survey confirming the vessel meets the applicable Commercial Yacht Code (sCYC 2024 for 12-24m, CYC 2025 for 24m+).
  • Safety equipment certificates, stability booklet, and crew manning documents.

Document Tip

The deletion certificate from your previous flag state is the document most likely to cause delays. Start the deletion process early, ideally before you submit the Malta application. Provisional registration can proceed without it, but permanent registration cannot.

Step-by-Step Process

1 Document Preparation

Mercer Yachting reviews your vessel particulars and ownership structure, then prepares the full document package. We'll tell you exactly which documents are needed and help you obtain any that are missing (such as tonnage certificates or declarations of conformity).

2 Application Submission

We submit the complete application to Transport Malta's Registrar-General. The application includes all core documents, the registration fee, and the vessel's technical particulars (LOA, beam, draught, GT, NT, hull material, engine details).

3 Provisional Certificate Issued

Transport Malta reviews the application and, once satisfied, issues the Provisional Certificate of Malta Registry. This typically takes 2-3 working days from submission of a complete application. The vessel can now fly the Malta flag.

4 The 6-Month Provisional Period

During this period, the vessel operates with full flag state protection. You can trade commercially (if registered as commercial), enter any port, and the vessel is covered under Maltese maritime law. Meanwhile, outstanding documents (particularly the deletion certificate) are finalised.

5 Permanent Registration

Once all documents are submitted and approved, Transport Malta issues the Certificate of Malta Registry. As of June 2025, this is issued digitally. The permanent certificate replaces the provisional one and is renewed annually.

6 Radio Licence and MMSI

Alongside registration, we apply for the Ship Radio Licence and MMSI number through Transport Malta. This covers VHF, satellite communications, EPIRB, and AIS identity.

7 Annual Renewal

Each year, the Certificate of Malta Registry must be renewed. Mercer handles the renewal process, ensuring the fee is paid and any changes to vessel details are updated before the renewal deadline.

Digital Certificate of Malta Registry

Since June 2025, Transport Malta issues the Certificate of Malta Registry in digital format. This is a significant improvement over the previous paper-based system.

The digital certificate can be shared instantly with port authorities, insurers, classification societies, and flag state surveyors. There's no risk of the physical document being damaged or lost during a passage. And renewal certificates are delivered electronically, eliminating courier delays.

The digital certificate carries the same legal weight as the previous paper version. Port state control officers worldwide are familiar with digital certificates from Malta, and the verification process is the same.

What If the Provisional Period Expires?

If the 6-month provisional registration expires before permanent registration is completed, the vessel can no longer fly the Malta flag. A fresh application is required, with new fees payable.

This is why document preparation matters. The most common cause of expiry is delays in obtaining the deletion certificate from the previous flag state. Some flag states take months to process deletions, which can eat into your provisional window.
