The Legal Requirement
Under Malta's Merchant Shipping Act (Cap. 234), every non-Maltese owner of a Malta-flagged vessel must appoint a resident agent in Malta. This isn't optional; it's a statutory requirement that applies to individuals, companies, and trusts alike.
The resident agent serves as the owner's legal representative in Malta. They're the point of contact between the vessel owner and Transport Malta, and they're responsible for ensuring the vessel remains in compliance with Maltese maritime law.
The requirement exists because Malta needs a local contact for every vessel on its register. If Transport Malta needs to communicate with the owner, issue a notice, or request documentation, the resident agent receives and acts on that communication.
What the Resident Agent Does
The resident agent's role goes well beyond receiving mail. It's an active, ongoing administrative and compliance function that covers the vessel's entire time on the Malta register.
Transport Malta Liaison
The agent communicates directly with Transport Malta on all registration matters. This includes the initial application, provisional and permanent registration, any amendments to vessel details, and flag state correspondence. When Transport Malta issues circulars, safety notices, or regulatory updates, the agent receives them and relays relevant information to the owner or management company.
Annual Renewal Management
The Certificate of Malta Registry must be renewed every year. The resident agent manages this process: tracking the renewal deadline, ensuring the fee is paid on time, confirming that vessel details are current, and collecting the renewed certificate (now issued digitally as of June 2025).
Radio Licence and MMSI
The agent handles the application for the Ship Radio Licence and MMSI number through Transport Malta. This covers all onboard communications equipment: VHF, MF/HF, satellite systems (Inmarsat, Iridium), EPIRB registration, and AIS transponder identity. Licence renewals are also managed by the agent.
Customs and Port Authority Communication
When Maltese customs or port authorities need to contact the vessel's owner (for example, during a port call in Malta or regarding documentation queries), the resident agent acts as the local point of contact. This ensures that official communications are received and responded to promptly.
Compliance and Administrative Changes
Any changes to the vessel's registration details (ownership transfer, name change, tonnage re-measurement, change of class) must be processed through Transport Malta. The resident agent prepares and submits the necessary documentation for these changes, ensuring the register stays current.
Who Needs a Resident Agent?
The short answer: every non-Maltese owner of a Malta-flagged vessel. But the specifics depend on your ownership structure.
EU Citizens (Not Resident in Malta)
If you're an EU, EEA, or Swiss national registering in your personal name but you don't live in Malta, you need a resident agent. Your EU citizenship allows you to register personally (without a company), but the agent requirement still applies because you're not Maltese-resident.
Non-EU Individuals via Maltese Company
If you're a non-EU national and you've set up a Maltese company to own the vessel, the resident agent requirement is technically removed. The Maltese company itself is the domestic legal entity. However, many owners in this situation still appoint a resident agent for practical reasons: someone to handle the ongoing administration with Transport Malta.
Non-EU Individuals via Foreign Company
If you're registering through a foreign company (accepted by the Registrar-General), a resident agent is mandatory. The foreign company has no presence in Malta, so the agent provides the required domestic representation.
Non-EU Companies
Foreign companies registering a vessel in Malta must appoint a resident agent, regardless of the company's jurisdiction of incorporation.
